Upon competitor registration, a liability waiver and photo/video consent and release form are required per performer/competitor.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

These Terms and Conditions may have been translated if we have made them available to you on our Service. You agree that the original English text shall prevail in the case of a dispute.

COMPETITORS/PERFORMERS

AERIAL ARTS SOCIETY INC requires a signed liability waiver and photo/video consent and release form found on the competitor registration prior to finalizing registration.
AERIAL ARTS SOCIETY INC is not liable for any injury or damage incurred by you during any stage of the competition.

AERIAL ARTS SOCIETY INC reserves the right to disqualify you, and/or bar you from entry to a future competition, if you breach the rules and regulations of the competition.

AERIAL ARTS SOCIETY INC reserves the right to make modifications to the rules, regulations, terms, and conditions of the competition at any time.

If a change is deemed necessary for safety reasons, it will take place immediately and AERIAL ARTS SOCIETY INC will make every effort to inform you as soon as possible either orally or in writing.

AERIAL ARTS SOCIETY INC will not be held liable for any expenses incurred by your participation in the competition.

AERIAL ARTS SOCIETY INC will not be held liable to you for any loss or expenses suffered either directly or indirectly resulting from a breach of AERIAL ARTS SOCIETY INC terms and conditions.

In the event of a breach of contract by AERIAL ARTS SOCIETY INC, your remedies shall be limited to damages not exceeding the price of the entry fee you paid.

AERIAL ARTS SOCIETY INC is committed to the highest standards of health and safety at all stages of the competition.

AERIAL ARTS SOCIETY INC will be using multiple apparatuses of a various sort throughout the competition and cannot be responsible for any damage to property or injury to persons or third parties during the use of this product.

AERIAL ARTS SOCIETY INC may license or subcontract all or any part of their rights and obligations without the competitors consent.

SPECTATORS
Tickets are a revocable license and AERIAL ARTS SOCIETY INC reserves the right to revoke any license at any time. All ticket sales are final, no refunds.

GENERAL
AERIAL ARTS SOCIETY INC maintains their headquarters in the county of Los Angeles, in the State of California and any disputes or claims shall be made under California law and under the exclusive jurisdiction of the California courts.

Any issues not already addressed within this document or on the AERIAL ARTS SOCIETY INC website or associated AERIAL ARTS SOCIETY INC materials will be made by AERIAL ARTS SOCIETY INC in due course. If any provision of these terms and conditions shall be invalid, void, illegal or unenforceable, the validity, existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.

Failure by the AERIAL ARTS SOCIETY INC to enforce any provision of these terms and conditions shall not be treated as a waiver of that provision, nor shall it affect AERIAL ARTS SOCIETY INC's right to subsequently enforce that provision.
